California has sparked conversation about whether tenure laws have swung too far toward protecting teachers, at the expense of the educational rights of students.
The debate is whether or not tenure policies can support both of those ideals. We think they can and should —but right now they're not, and like California, other states may soon face a court order to change. In the rush to fix tenure, some will argue that it should be just scrapped altogether. Whilst in the past, lack of attention on the part of directors attending meetings may have been tolerated, the current performance of directors is demanding consideration of not only who sits on the board but how long they sit there.
For instances where board terms are specified, most terms are usually set at three years. Commonly, the term is set at three years with mandatory retirement after two or three, three year teams. For example, Singapore Airlines mandates a 6 year maximum term for directors as do some super funds.
During the time I have been part of a doctoral program, a number of colleges and universities have negotiated contracts for adjuncts. We no longer need advice for individual faculty. We are overdue for attending to real institutional change. Hope for most young professionals in the academy relies not on following tips for obtaining a tenure-track job but rather in the solidarity from those with job security when it comes to tackling the growing insecurity of the majority of the academic work force.

By Jamie J. December 9, Tenure-track faculty must recognize openly that as the system stands, tenure is not a possibility for most Ph. The academic job market has been abysmal for as long as I can remember, but things have only gotten worse recently. This finding has led to an intense policy focus on teacher quality. Policymakers are concerned with identifying teacher excellence, understanding the barriers to assuring excellent teachers in every classroom, and developing policies to cultivate and nurture excellence.
They are also focused on identifying and removing weak teachers. Thus, discussions of teacher quality invariably lead to discussions of ten- ure, a concept much misunderstood, and often unfairly identified as the major obstacle to assuring that all children are taught by effective teachers. Teacher tenure in elementary and secondary school has been part of the educational landscape since , when New Jersey passed a law to protect teachers from the whims of autocratic principals and patronage allocating administrators.
Until then, teachers could be fired for speaking up, questioning educational practices, or merely because an administrator wished to give the job to someone else for political reasons or nepotism. The initial impulse for developing tenure laws was to protect teachers from unfair dismissal, but today there is concern that tenure laws are anachronistic and create more problems than they solve. Many education policymakers now believe that civil rights legislation passed over the last half century protects teachers from unfair dismissal, making tenure laws obsolete.
They further claim that tenure laws do not assure quality teaching and often lead to unnecessary complications in dismissing veteran teachers who are ineffective. Teachers and their unions, however, insist that guarantees of due process are still necessary given the current harsh political climate in which school administrators often find themselves.
They fear that teachers unfairly will be made the scapegoats for all the ills of public education and will suffer undeserved consequences at the hands of poorly developed accountability systems. This report examines whether tenure, as it currently operates in the states, lives up to its original goals of assuring a high quality veteran teaching force and protecting teachers from arbitrary and capricious dismissal.
It concludes that tenure laws need fixing. The paper finds that:. Most current state and district tenure provisions, both for earning tenure and revoking it, need a serious overhaul.
School systems need to consider evidence of student learning when granting continuing status to teachers. In general, learning-working conditions are not considered in tenure decisions.
